Terms and Conditions
Here is a copy of the Terms and Conditions, you as a parent/carer will be expected to sign:
Nursery Places and Bookings
The nursery must receive a signed and fully completed registration form before any place can be considered. Parents/carers can request sessions at this point where the nursery will do their best to meet individual needs.
Registration Fees and Deposit
The nursery does not require a deposit to get a place at the nursery, however does require a non – refundable registration fee of £60.00. This is to be paid at the time of submitting a completed registration form, this will only be returned to parents / carers if the nursery is unable to offer a suitable place for their child.
If you require a funded only place, then a £20 holding fee is required to hold the space and will be returned upon your child’s first day. Should your child not start with us the fee becomes non – refundable.
If the nursery offers the parent/carer a place for their child on the waiting list the registration fee is required to be paid and is non – refundable, however after being on the waiting list the nursery is unable to offer the child a place then the parent/carer would be entitled to the registration fee to be returned. If the parent/carer is offered a place within the nursery and decide to decline the place then the registration fee remains non – refundable.
Fees and Invoices
Nursery fees are payable in advance by cash, bank transfer or workplace vouchers by the 1st of every month. Cash payments from the 1st October will be subject to a 2% charge.
All invoices will be emailed from the nursery on the 15th of each month. If the invoice is not received by the parent/carer then it is the responsibility of the parent/carer to report this to the nursery.
Any late payments delivered after the 7th will incur a £10.00 daily charge. Other than if we are in breach of these Terms and Conditions, all sessions booked must be paid for, regardless of whether the child attends. No refunds will be given for sessions missed due to holidays or sickness. Failure to meet payments will result in the termination of the nursery place and in such circumstances the parents will not be entitled to a refund of any fees. Any costs incurred by the nursery to recover any unpaid fees will be added to any outstanding balance.
The nursery offers a reduced fee if you enrol your second child and subsequent children with us. If both children attend two days (four sessions) with us you will receive a 5% discount on the older child’s fees. If they both attend more than four sessions a 10% discount will be given on the older child’s fees.
Early Years Entitlement
Early years Entitlement funding is available for all 3 and 4-year olds from the term after their third birthday.
If parents/carers only require a funded place, then the registration fee is optional for these parents. This is only available for term time only places. Any additional sessions required in the holidays will need to be paid upfront before the child is able to attend the session. Usually at least 24 hours’ notice is required to book in for extra sessions, although the nursery will aim to accommodate any request depending on availability.
No parent / carer will be required to book more funded hours than needed so for example if you only require half a session if there is availability the nursery will accommodate this however this will be reviewed on a termly basis and the place will need to re-offered depending on availability therefore if someone is wanting to use a full session space they will take priority for the session which could result in the loss of space and or session.
The extended 15 hours funding will only be offered upon the nursery receiving an eligibility code. If you lose eligibility for any funding at any point all sessions will become chargeable at the current full session price.
Two Year Funding
We also accept two-year olds on the funding. Please contact your local children’s centre to find out if you are entitled to this. The same terms and conditions apply as with the 3 and 4-year-old funding.
If your child is leaving another setting where you currently claim funding you must inform the nursery straight away. If you lose eligibility for any funding at any point all sessions will become chargeable at the current full session price.
Operating hours
ApplePips Day Nursery is open from 08:00 – 18:00 fifty one weeks a year, running a variety of sessions during these hours. Those sessions will be as follows: Am 08:00 – 13:00; Pm 13:00 – 18:00 and Full Day 08:00 – 18:00 If you are late collecting your child from the nursery a late collection charge of £8.00 for every 15 minutes may be imposed – this is down to the discretion of the nursery manager.
Please be punctual.
Nursery Closure
The nursery is open as specified in the prospectus. The nursery will be closed over the Christmas period, closing on Christmas Eve and reopen after New Year’s Day (unless Christmas Eve falls on a Monday, then the nursery will close the Friday before and reopen in the New Year.) For all other bank holiday(s) during the year the nursery will remain closed.
Behaviour Management
We may require parents to withdraw or remove their child from the nursery if the nursery manager considers the child to be disruptive or displaying inappropriate behaviour.
We will not tolerate nursery staff being spoken to in an abusive or threatening manner by any person(s) entering the nursery including parents/carers or children. Such behaviour may result in the termination of a nursery place.
Insurance
We have extensive insurance cover – full details of the nursery insurance are available upon request from the nursery manager.
Personal property and belongings
We cannot be held responsible for any loss or damage to children’s property. Every reasonable effort will be made by the nursery staff to ensure the children’s belongings are not lost or damaged. Practical ‘inexpensive’ clothing is strongly recommended for children attending Applepips Day Nursery. It is the parent/carers responsibility to name and clearly label all items of clothing. We suggest that all toys, books or other equipment is left at home.
Termination / Cancellation / Change
We require one month’s notice in writing, should you wish to terminate a nursery place for any reason. Parents/carers still remain liable for fees throughout the notice period. If parents/carers withdraw their child during this notice period, the fees shall remain payable (If you claim funding the nursery does require half a term’s notice to terminate a place). We reserve the right to terminate a nursery place with immediate effect if any fees are not paid by the due date, or if a parent/carer or child display abusive, threatening or otherwise inappropriate behaviour.
In other circumstances, we will give you one months’ notice, in writing, should we wish to terminate a nursery place for any reason.
If parents/carers for any reason postpone a start date, we reserve the right to charge from the original start date stated on the registration form. If a parent/carer wishes to change the number of sessions taken at the nursery, one months’ notice in writing, unless there is another child on the waiting list whom is able to fill the place straight away. If you require an increase in sessions it will availability dependent on when the changes can take effect.
Liability
We accept no responsibility for any loss suffered by parents/carers, arising directly or indirectly, because of the nursery being temporarily closed or the non – admittance of your child to the nursery for any reason, this applies to absence due to sickness, holidays and Bank Holidays. We accept no responsibility for children whilst in their parent/carers care on nursery premises, i.e. prior to arrival or after pick up.
We will not be liable to parents/carers and or children for any economic loss of any kind, for damage to the child’s or parent/carers’ property, for any loss resulting from a claim made by any third party or for any special, indirect or consequential loss or damage of any kind.
We will make reasonable endeavours to keep parents and / or children’s property in good order.
Liability for damage of such property is excluded except where caused by negligence.
Accidents and illness
We reserve the right to administer basic first aid and treatment when necessary. Parents/carers will be informed of all accidents and will be required to sign an accident form. For accidents of a more serious nature, involving hospital treatment, all attempts will be made by the nursery to contact the parents/carers but failing this, we are hereby authorised to act on behalf of parents and authorise necessary treatment.
We will administer prescribed medicines if parents/carers complete a ‘medicine form’; however, the first dose of medicine must be given at home and parents/carers must take all medicines home at the end of each day, except for long term medication for example inhalers.
We may require parents/carers to withdraw their child from nursery if they require medical care or attention, or it is considered that the child is not well enough to attend nursery. We may also ask parents/carers to withdraw their child from nursery, if we have reasonable cause to believe that they are or maybe suffering from or has suffered from any contagious disease/infection and there remains a danger that other children at the nursery may contract such disease / infection. We accept no responsibility for children contracting contagious diseases / infections. Parents/carers are requested to inform the nursery if their child is suffering from any illness, sickness or allergies before attending nursery.
We have a realistic attitude to the needs of the working parents/carers but we reserve the right to contact parents / carers if their child becomes ill during the nursery hours.
Security
Under no circumstances will the child be allowed to leave nursery with anyone unknown to nursery staff unless the parents/carer have previously arranged this. If the parent/carer has made alternative arrangements by telephone the nursery will require the name, telephone number description and password for the person permitted to collect their child and the collection policy and procedure will be followed. A list of responsible adults who are authorised to collect the child should be given to the nursery staff. The nursery will have a door security system so only staff will be allowing people access into the building.
General Information
Parents/carers are requested to inform the nursery of any food, medicine, activity or any other circumstances that may cause the child to have an allergic reaction / allergy. Parents/carers must provide details, in writing, of the severity of the reaction / allergy and must continue to inform the nursery of any changes/progress to the condition, in writing, when they become aware. Parents/carers are requested to inform the nursery of any changes to all information kept by the nursery.
Data
I have read and understand the privacy agreement I have been given and agree to my data being stored in line with this privacy agreement and in accordance to the data retention guidelines.
Agreement
These terms and conditions represent the entire agreement and understanding between the parents / carer and the nursery. Any other understandings agreements, warranties, conditions, terms or representations, whether verbal or written, expressed or implied are excluded to the fullest extent, permitted by law. We reserve the right to update / amend these terms and conditions at any time.
By signing this contract you are agreeing to all terms and conditions and all nursery policies and procedures which are available on Tapestry, in parent policy folders and upon request.
